Know the Process to Obtain a Utility Patent

Steps to Get Utility Patent


Step 1: Seek for a Patent:

Instead of getting applications rejected, the owner needs to seek if their patent has already been granted or not with the help of the USPTO (United States Patent and Trademark Office)database.

Step 2: Determine Filing Strategy
The owner of the patent needs to decide whether to file a provisional or non-provisional utility application. The period of the provisional application is 12 months from the date of the issue of the provisional application. Along with the provisional application, the creator needs to file a non-provisional application that will provide benefits to the patent applicant. 

Step 3: Examine Utility Patent
The process of examination once the creator files a request for examination. Examination of Utility paten takes 48 months from the date of applying for the application. In the first examination phase, the examiner prepares a report which includes all the statutory objections of the patent application. 

Step 4: Prepare for Electronics Filing
To get a patent, the owner needs to prepare electronics filing. For this, the creator needs to pay the application processing fee. It is in computing to the relevant fees in the Patent Application Filing Fees. 

Step 5:Overcome all Objection
Once the examination process is done, the candidate needs to overcome all the objections by the examination chamber. In case, if the candidate does not overcome all the objection, its patent application will be rejected by the USPTO. Therefore, it is important to overcome objections.

Step 6: Utility Patent Grant
After all the objections have been overcome by the candidate, a utility patent is granted to the creator.
